Grounds for a complaint

If the goods you received do not conform to the contract (for example, they are defective or damaged), you have the right to file a complaint. The Seller is liable for the lack of conformity of the goods with the contract under the rules on non-conformity of goods in force since 1 January 2023 (which replaced the former statutory warranty for consumer sales). This liability lasts 2 years from the delivery of the goods.

How to file a complaint

You can file a complaint:

  • by email to [email protected],
  • in writing to the Seller's registered address: J&F Investing Sp. z o.o., Sobótka 91, 63-450 Sobótka, Poland.

In your complaint, please give: your first and last name, order number, a description of the non-conformity (defect) with the date it appeared, and what you are requesting.

03

Processing time

We will process your complaint within 14 days of receiving it and inform you of the outcome at the email or postal address you provided. If we do not respond to the complaint within this period, it is deemed to have been accepted.

04

Your rights

First, you may request that the goods be brought into conformity with the contract by repair or replacement. You may request a price reduction or withdraw from the contract (and receive a refund of the amount paid) if the lack of conformity is significant, and also, among others, if we refuse to repair or replace the goods, fail to bring them into conformity within a reasonable time or without undue inconvenience, or if the lack of conformity persists. The Seller bears the costs of repair or replacement (including shipping).

05

Out-of-court dispute resolution

You may use out-of-court methods of handling complaints and pursuing claims. In Poland, free help is provided by, among others, district (municipal) consumer ombudsmen and consumer organisations. You can also refer a dispute to the Voivodeship Inspectorate of Trade Inspection or to a permanent consumer arbitration court. The register of bodies authorised to resolve consumer disputes out of court is kept by the President of the Polish Office of Competition and Consumer Protection (UOKiK) — available at polubowne.uokik.gov.pl. More information is available at uokik.gov.pl. Using these methods is voluntary for both parties.
